Settlement for 34 year-old man who was rear-ended by a drunk driver in his company issued van on St. Patrick’s Day. The defendant regularly drank at the bar across the street from his job site, including on the date of accident, allowing us to plead punitive damages against his employer since they knew or should have known of his prior DUI history and drinking before the accident. The defense in this case contended that the plaintiff and/or his employer were solely responsible for his injuries, as they had been the ones that actually nailed the board he fell through.
