Aggravation of Existing Degenerative Conditions


$2.0 million settlement for 43-year-old union laborer who had multiple prior back surgeries and knee surgeries who was ordered to move 4×8 sheets of plywood on the 40th floor “top deck” of a down town building then under construction when the wind caught the plywood and caused him to fall onto a pile of joists. Plaintiff claimed aggravation of preexisting degenerative conditions to his back and knee requiring additional surgery. The case settled at trial after opening statements.
