Who Can Be Held Liable for a Haunted House or Corn Maze Injury?

Most of these cases are premises liability claims. Property owners and occupiers owe visitors reasonable care regarding the condition of their property. For a paying attraction, that means inspecting for hazards, fixing or warning about them, and operating safely.

Depending on the facts, responsible parties may include:

  • The property owner, such as the farm or venue that hosts the attraction.
  • The operator or event company, which may lease the land and run the attraction.
  • The employer of staff and actors, if poor hiring, training or supervision led to the injury, or if an actor crossed the line into physical contact.
  • Equipment manufacturers, if a defective wagon, ride or animatronic prop caused harm.
  • A government entity, if a park district or municipality ran the event. These claims follow special rules and shorter notice periods.

Many haunted houses and walk-through attractions are also subject to state safety oversight under the Illinois Amusement Ride and Attraction Safety Act. A failed inspection or missing permit can be important evidence.

Does Signing a Waiver Mean You Can't File a Claim?

Not necessarily. Illinois courts may enforce these agreements, but they read them strictly against the business. A waiver generally cannot protect a business from willful and wanton conduct, and it may not cover a hazard the waiver did not clearly describe. Waivers signed by parents on behalf of children may also receive extra scrutiny.

Illinois also follows modified comparative fault. Your compensation can be reduced by your share of fault, and you cannot recover if you are found more than 50% at fault. Operators often argue that guests ran, ignored posted rules or had been drinking, so careful documentation matters.

What Should You Do If You Are Injured at a Fall Attraction?

  1. Get medical care right away. Concussion symptoms can be delayed.
  2. Report the incident to management and ask for a copy of the incident report.
  3. Take photos and video of the hazard, the lighting, any warning signs and your injuries.
  4. Collect names and contact information for witnesses and staff members involved.
  5. Keep your ticket, receipt, wristband and any waiver, along with the shoes and clothing you wore.
  6. Avoid posting about the incident on social media and do not give a recorded statement to an insurance company.
  7. Talk to a Parente & Norem personal injury attorney promptly. Illinois sets strict deadlines for filing injury claims, and claims against government entities may have even shorter notice requirements.
