Construction Worker falls


$1.1 million settlement for a 31-year-old construction worker who fell through an overhang when he stepped on a piece of wood blocking he had previously nailed and sustained a serious right heel fracture. We sued the general contractor and owner and shortly before trial obtained not only a settlement amount of $1.1 million but reduced his worker’s compensation lien by $273,000. The defense in this case contended that the plaintiff and/or his employer were solely responsible for his injuries, as they had been the ones that actually nailed the board he fell through.
